3. Products — Digital & Physical

3.1 All products are sold subject to availability. Product images are as accurate as possible, but colours may vary slightly depending on your screen settings.

3.2 Digital products (such as templates, design files, and other downloadable assets) are delivered electronically upon completion of payment, typically via email or an instant download link. It is your responsibility to ensure you provide a valid email address and to keep your own backup copies of purchased files.

3.3 Digital products are licensed, not sold outright. Unless otherwise stated on the product page, purchase grants you a personal or commercial use licence as specified at the point of sale. You may not resell, redistribute, or share purchase files as though they were your own original work, or claim copyright over them.

3.4 For physical products, details including materials, dimensions, and production time are listed on each product page.

4. Pricing & Payment

4.1 All prices are listed in Australian Dollars (AUD) unless otherwise stated.

4.2 We reserve the right to change prices at any time without notice.

4.3 Payment must be made in full at the time of purchase. We accept payment via the methods listed at checkout.

4.4 Colton Creative is not responsible for any currency conversion fees or bank charges that your financial institution may apply.

5. Shipping & Delivery

5.1 Digital products are delivered electronically and are not shipped. Delivery is generally instant or within the timeframe stated on the product page.

5.2 We ship physical products domestically within Australia and internationally. Shipping costs are displayed at checkout.

5.3 Delivery timeframes for physical products are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or circumstances beyond our control.

5.4 Risk of loss or damage to physical products passes to you upon delivery to the shipping carrier. We recommend purchasing shipping insurance for high-value items.

5.5 International orders may be subject to customs duties, taxes, or import fees, which are the responsibility of the buyer.

6. Returns & Refunds

6.1 Under Australian Consumer Law, you are entitled to a refund or replacement if a product is faulty, damaged, or not as described.

6.2 Digital products: due to the nature of digital goods, we do not offer refunds or exchanges once a file has been downloaded or delivered, except where required under Australian Consumer Law (for example, if the file is faulty, corrupted, or significantly different from what was described). If you experience a problem downloading or opening a file, contact us and we will work with you to resolve it.

6.3 Physical products: if you receive a damaged or incorrect item, please contact us within 7 days of delivery with photographic evidence and we will arrange a replacement or refund.

6.4 Return shipping costs for physical products are the buyer's responsibility unless the return is due to our error.

7. Design Services & Commissions

7.1 All client design work (such as branding, web design, or custom design services) requires a written brief and agreement before commencement.

7.2 A deposit (typically 50%) is required to begin a project. The remaining balance is due upon completion and prior to final delivery of files.

7.3 Revisions are limited to those agreed in the project scope. Additional revisions may incur extra charges.

7.4 Colton Creative retains the right to display client work in our portfolio unless otherwise agreed in writing.

8. Intellectual Property

8.1 All designs, templates, images, and content on this website are the intellectual property of Colton Creative and are protected by copyright.

8.2 Purchase of a digital product grants you a licence to use the files as set out in Section 3.3, not ownership of the underlying design or copyright. Purchase of a physical product grants you ownership of the physical item only.

8.3 For client design services, ownership and copyright of final deliverables will be set out in the project agreement. Unless otherwise agreed in writing, Colton Creative retains copyright in preliminary concepts, working files, and any elements not part of the final agreed deliverable.

8.4 You may not reproduce, distribute, resell, or create derivative works from any content on this website, or from purchased digital products beyond the granted licence, without our prior written consent.

9. Limitation of Liability

To the extent permitted by law, Colton Creative will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or purchase of our products or services. Our total liability to you will not exceed the amount paid for the relevant product or service.

10. Changes to These Terms

We reserve the right to update these Terms at any time. The current version will always be available on our website. Continued use of our website after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
