These Terms and Conditions ("Terms") govern your use of the Colton Creative website and the purchase of artworks, prints, and services offered by Colton Creative ("we", "us", or "our"). By accessing our website or placing an order, you agree to be bound by these Terms.

2. Use of This Website
By using this website, you confirm that:
You are at least 18 years of age, or are accessing the site under the supervision of a parent or guardian.
You will not use this website for any unlawful purpose.
You will not attempt to gain unauthorised access to any part of the website.
You will not copy, reproduce, or distribute any content from this website without our written permission.
3. Products — Artworks & Prints
3.1 All original artworks and prints are sold subject to availability. Product images are as accurate as possible, but colours may vary slightly depending on your screen settings.
3.2 For original artworks, each piece is one-of-a-kind. Once sold, it will be removed from sale.
3.3 For prints, details including edition size (if applicable), paper type, and dimensions are listed on each product page.
4. Pricing & Payment
4.1 All prices are listed in Australian Dollars (AUD) unless otherwise stated.
4.2 We reserve the right to change prices at any time without notice.
4.3 Payment must be made in full at the time of purchase. We accept payment via the methods listed at checkout.
4.4 Colton Creative is not responsible for any currency conversion fees or bank charges that your financial institution may apply.
5. Shipping & Delivery
5.1 We ship domestically within Australia and internationally.
5.2 Shipping costs for prints and smaller items are displayed at checkout. Some original artworks are listed as 'Enquire to Purchase'. For these works, once you submit an enquiry we will provide a full quote including the artwork price and shipping cost. No payment is required until you have reviewed and agreed to the total. You are under no obligation to proceed.
5.3 Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or circumstances beyond our control.
5.4 Risk of loss or damage passes to you upon delivery to the shipping carrier. We recommend purchasing shipping insurance for high-value items.
5.5 International orders may be subject to customs duties, taxes, or import fees, which are the responsibility of the buyer.
6. Returns & Refunds
6.1 Under Australian Consumer Law, you are entitled to a refund or replacement if a product is faulty, damaged, or not as described.
6.2 We do not offer refunds or exchanges for change of mind on original artworks or commissioned works.
6.3 For prints, if you receive a damaged or incorrect item, please contact us within 7 days of delivery with photographic evidence and we will arrange a replacement or refund.
6.4 Return shipping costs are the buyer's responsibility unless the return is due to our error.
7. Commissioned & Creative Services
7.1 All commissioned work requires a written brief and agreement before commencement.
7.2 A deposit (typically 50%) is required to begin a commission. The remaining balance is due upon completion and prior to final delivery.
7.3 Revisions are limited to those agreed in the project scope. Additional revisions may incur extra charges.
7.4 Colton Creative retains the right to display commissioned work in our portfolio unless otherwise agreed in writing.
8. Intellectual Property
8.1 All artworks, designs, images, and content on this website are the intellectual property of Colton Creative and are protected by copyright.
8.2 Purchase of an artwork or print grants you ownership of the physical item only. Copyright remains with Colton Creative unless explicitly transferred in writing.
8.3 You may not reproduce, distribute, or create derivative works from any content on this website without our prior written consent.
9. Limitation of Liability
To the extent permitted by law, Colton Creative will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or purchase of our products. Our total liability to you will not exceed the amount paid for the relevant product or service.
10. Changes to These Terms
We reserve the right to update these Terms at any time. The current version will always be available on our website. Continued use of our website after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
